Analytical revelations from the Justice Department Inspector General’s report on the conduct of the “Russia-Trump” investigation won’t end any time soon.

 

The highlights have come out quickly, such as the startling count of 51 procedural violations by the FBI just in forwarding the FISA applications on Carter Page, and the fact that nine of those 51 involved making false statements to the FISA court.  In light of these and other findings, the IG report’s conclusion that all this troubling conduct didn’t amount to “bias” on the part of the FBI seems rather … beside the point.  Pick another measuring stick, folks.  That one is about as useful to our public purpose as Gloria Steinem’s famous bicycle was to a fish.

 

Whatever we label it – and “bias” is an unimpressive scare word to begin with – a federal law enforcement undertaking so full of violations and false statements is a problem of the highest priority.  So call it Petunia, for all I care.  Just don’t have the crust to call it something that frames it to be written off.  Real, live Americans have to live every day with what we suffer the FBI to do in the name of law and order.

 

And if the senior officials at headquarters are allowed to misbehave themselves so badly, it doesn’t much matter how honorable the rank and file are.

 

In any case, although there is surely a lot more to come as the IG report gets its public walk-through, Rep. Devin Nunes (R-CA) bore-sighted Monday evening on the question that must propel us forward.

 

The IG report only takes us so far.  That’s because it accepts the start date of its investigative charter as the day Operation Crossfire Hurricane was launched by the FBI: 31 July 2016.

 

We’ll learn a lot from looking at the period after that.  But the operations of U.S. agencies against (or, if you like, “involving”) members of the Trump campaign were underway well before that.  Even if we use the friendlier-sounding term “involving” here, it’s still the case that agencies and personalities that engaged with Trump campaign members after 31 July 2016 were also involved with them before 31 July 2016.

 

Devin Nunes called that out on Monday.  He’s brought this up previously, and didn’t elaborate at length in his segment with Sean Hannity (whose audience wouldn’t need a lengthy explanation).  But that’s what he’s referring to here.

 

And his question is the essential one.  The DOJ IG report looked at the conduct of the FBI and DOJ in Crossfire Hurricane.

 

But who was coordinating what was being done before Crossfire Hurricane started?

 

That question gets to the fundamental mystery of how the counter-Trump operation was started, and who was behind it.  The motive for the operation can only be ascertained fully by answering these questions.  The FBI was a late-comer to the game.  It wasn’t “the” string-puller (which was probably a small group, rather than a single individual).

 

If nothing else, Peter Strzok’s affect in 2016 tells us that.  He doesn’t text like someone who has known for months – or years – that Stefan Halper was set onto LTG Michael Flynn back in 2014, or that Carter Page has been working with the FBI since 2013 to take down Russian agents in the United States.

 

And that’s really the point about the IG report too.  The report is framed as if it’s kind of no big deal that there was prior engagement by the actors in its own drama with the Crossfire Hurricane targets:  Paul Manafort, Carter Page, George Papadopoulos, and Michael Flynn.

 

The IG report accepts at face value the narrative that Crossfire Hurricane was initiated on 31 July 2016, based on the nugget from Australian diplomat Alexander Downer that in May 2016, George Papadopoulos had told him something about the Russians and incriminating information on Hillary Clinton.

 

Yet within two weeks of 31 July 2016, this new operation had turned unerringly to a confidential source (Stefan Halper) who had known Paul Manafort for years, had engaged with Michael Flynn back in 2014, and had invited Carter Page to a conference at Cambridge in July 2016 (where Halper and Page happened, according to Halper, to discuss the possibility of Halper joining the Trump campaign), before Crossfire Hurricane started.

 

Meanwhile, the FBI had had Manafort under investigation several years earlier, and had electronic surveillance of him since 2014 (up through probably March of 2016, when reporting suggests the FISA authority for that surveillance expired).

 

The FBI had been receiving cooperation from Carter Page in interdicting Russian agents in the U.S. who were trying to recruit Americans.

 

And Stefan Halper, whom the IG report refers to as Source 2 (with a number of allusions that make Halper the only viable candidate for that designation), had been involved in an apparent attempt to pin the appearance of improper Russian connections on Michael Flynn in 2014.

 

Papadopoulos, on the other hand, while he had not been approached by Halper before 31 July 2016, had been approached in March 2016 by the Maltese professor, Joseph Mifsud, who was well known to the U.S. State Department and ran tame among the top officials of the British and Italian intelligence organizations.  Papadopoulos was subsequently approached by Alexander Downer, the Australian diplomat with extensive links to the same UK intelligence officials Stefan Halper hosted conferences with at Cambridge multiple times each year.

 

There are a couple of passages in the IG report that afford an intriguing look at how these remarkable coincidences were accounted for in testimony to the IG.

 

We are given a little background on Stefan Halper’s (Source 2’s) checkered history as a confidential source (p. 313 as page-numbered in the IG report document):

 

Source 2 was closed by the FBI in 2011 for “aggressiveness toward handling agents as a result of what [Source 2] perceived as not enough compensation” and “questionable allegiance to the [intelligence] targets” with which Source 2 maintained contact. However, Source 2 was re-opened 2 months later by Case Agent 1, and was handled by Case Agent 1 from 2011 through 2016 as part of Case Agent 1 ‘s regular investigative activities at an FBI field office.

 

Case Agent 1 remains anonymous in the report and has not been firmly identified by blogosphere analysts.  He is referred to as male in the report, however, and was working Crossfire Hurricane in 2016.*  He is described as having an extensive history with Source 2 between 2011 and 2016.

 

Therefore, we get the following characterization a couple of paragraphs later (on p. 314):

 

Source 2 ‘s involvement in the Crossfire Hurricane investigation arose out of Case Agent 1’s pre-existing relationship with Source 2. Case Agent 1 told the OIG that when he arrived in Washington, D.C. in early August 2016 to join the Crossfire Hurricane team, he had never previously dealt with the “realm” of political campaigns. He said he lacked a basic understanding of simple issues, for example what the role of a “foreign policy advisor” entails, and how that person interacts with the rest of the campaign. Case Agent 1 said he proposed meeting with Source 2 to ask these questions because Case Agent 1 knew that Source 2 had been affiliated with national political campaigns since the early 1970s.

 

Case Agent 1 seems to have known the source he had been handling since 2011 reasonably well.  So this passage in the middle of p. 315 comes across as a bit puzzling:

 

Source 2 told the Crossfire Hurricane team that Source 2 had known Trump’s then campaign manager, Manafort, for a number of years and that he had been previously acquainted with Michael Flynn. Case Agent 1 told the OIG that “quite honestly … we kind of stumbled upon [Source 2] knowing these folks.” He said that it was “serendipitous” and that the Crossfire Hurricane team “couldn’t believe [their] luck” that Source 2 had contacts with three of their four subjects, including Carter Page.

 

It strains credulity just a bit, that Case Agent 1, who’d been handling Source 2 since 2011, found it mere “luck” to discover that Source 2 knew Manafort, whom the FBI had investigated intensively since 2011, and had contacted Carter Page, with whom the FBI had worked since 2013, only a couple of weeks before Case Agent 1 joined Crossfire Hurricane.

 

Perhaps Case Agent 1 had no reason, at least, to know about Source 2’s connection with Michael Flynn.  But as for the rest, it sounds for all the world as if Case Agent 1 read a Wikipedia entry on Source 2 to get his background information, and then was disingenuously astonished to find out how relevant to Crossfire Hurricane Source 2’s history would actually be.

 

Case Agent 1’s protestations sound, in other words, less than credible.

 

His and the Crossfire Hurricane team’s reported disbelief in their “luck” requires accounting for, given the extensive history of the FBI with everyone that “luck” applied to.

 

That’s where Devin Nunes’s question comes in.  If it wasn’t the FBI that assembled all that “luck” prior to 31 July 2016 – who was it?  And was it, as we would reasonably assume, the same maker of “luck” that manufactured a series of contacts in early 2016, and then handed George Papadopoulos to the FBI, tied up with a bow?

 

Obviously, readers will be waving their hands in the air at this point calling out “Brennan!”  But it’s equally obvious John Brennan couldn’t do this alone.  Just for starters, the Steele dossier was a key component of the anti-Trump operation, and there is neither need nor evidence for connecting it to Brennan’s instigation (at least not directly).

 

Moreover, the collaboration that may have come from foreign intelligence agencies (e.g., in Italy and the UK, as well as the notorious grab-bag of other European sources, like Estonia, supposedly plying Brennan with information in early 2016) would have had motives other than merely helping Brennan out with a personal project.  For those sources, motives related to their own perceived interests had to be in play.

 

There are probably reasons the public will never be cleared for why Brennan would have taken a set against Michael Flynn.  We know of one reason why senior personnel at the DOJ might have.

 

Meanwhile, the odd centrality of Ukraine and Paul Manafort to the Russiagate drama seems to have had its origins and motives from other actors: in the State Department, in the Democratic Party, in at least one of the Democrats’ major funders, George Soros.  And those origins and motives appear, like the animus against Flynn, to have predated even Donald Trump’s candidacy for president.

 

Nunes is right.  This is what we need to get to the bottom of.  All that “luck” the Crossfire Hurricane team stumbled into: who authored it?  Will John Durham be able to dig that out?  Is he making the attempt?

 

William Barr’s comments this week, which include a reference to looking at the activities of other agencies (besides the FBI and DOJ), suggest that at least some version of that attempt may be underway.  But we don’t know its scope or quality.

 

If we get a few indictments for things done by DOJ and FBI personnel after 31 July 2016, and if Trump weathers the impeachment frenzy unscathed – and if we complacently accept never knowing the answer to Nunes’s question – we remain at grave risk for something like this happening again.  We remain at risk for not understanding the alarming power our government’s intelligence and law enforcement tools can wield over our nation’s future.

 

That’s why one of the most important things the IG report can do is point us not only to opportunities for indictment, but to discrepancies in testimony and narrative that set channel markers: buoys we can navigate by in chasing down Nunes’s question.

 

The alarm he raised in early 2017 is what cued both his committee and an interested public to demand the exertions that got us to the DOJ IG report.  In his excellent new book The Plot Against the President, journalist Lee Smith recounts much that was previously unreported about Nunes’s efforts and the centrality of his role.  Without Nunes, we wouldn’t have the broad public understanding we have today of the truth about Russiagate and Spygate, as opposed to the script written by Fusion GPS and pounded in the media.

 

I suggest trusting Nunes one more time: that we cannot rest until we know how and with whom this whole business really started.

 

* Regarding the identity of Case Agent 1, Internet sleuths are lobbying for one of two FBI agents who have spoken at Halper-organized events at Cambridge in the last decade.  This tweep suggests one of them (who was an FBI attaché at the U.S. embassy in London from 2012 to early 2016).  That agent has been a speaker for Halper at least twice.  In an article for The Federalist, Mollie Hemingway had a list of three names – including the one suggested by @TheLegalBrain1 – of FBI agents who appeared at a Halper conference in Cambridge in 2011.  Other analysts are partisans of the third name in the 2011 list for Case Agent 1.

Breaking: Rep. Doug Collins Releases Nellie Ohr Testimony Transcript Before House Judiciary Committee — Contributing ‘Author’ of Phony Dossier

In December 2017 the head of opposition research firm Fusion GPS admitted in a court filing that his firm paid Nellie Ohr, the wife of senior Justice Department official Bruce Ohr, to help dig up damaging information on then-candidate Donald Trump.

 

The connections between Nellie Ohr and the ‘Spygate’ scandal were hidden at a distance for months.

 

As noted previously at TGP, Nellie Ohr is a Communist sympathizer connected to Russia as well as a corrupt Never-Trumper.

 

Author Diana West at the American Spectator posted an article on Nellie Ohr last year.  Nellie Ohr is “the “dossier” spying scandal’s woman in the middle.”

 

To one side of Ohr, there is the Fusion GPS team, including fellow contractor Christopher Steele. To the other, there is husband Bruce Ohr, who, until his “dossier”-related demotion, was No. 4 man at the Department of Justice, and a key contact there for Steele.

 

What’s more revealing about Nellie Ohr is the men in her life are protecting her involvement in the Russia scandal:

 

Notably, the “dossier” men in her life have tried to shield Ohr from public scrutiny, even at professional risk. Her husband, as the Daily Caller News Foundation reports, failed to disclose his wife’s employment with Fusion GPS and seek the appropriate conflict-of-interest waiver, which may have been an important factor in his demotion from associate deputy attorney general late last year.

 

Under Senate and House questioning, Fusion GPS co-founder Glenn Simpson consistently failed to disclose Nellie Ohr’s existence as one of his firm’s paid Russian experts, let alone that he hired her for the red-hot DNC/Clinton campaign Trump-Russia project.

 

Even Christopher Steele may have tried to keep Nellie Ohr “under cover.” Steele, put forth as the “dossier” author ever since its January 2017 publication in BuzzFeed, does not appear to have let on to his many media and political contacts that he had “dossier”-assistance from at least two fellow Fusion GPS Russian experts, Nellie Ohr and Edward Baumgartner. Baumgartner, interestingly, was a Russian history major at Vassar in the 1990s when Nellie Ohr taught Russian history there.

 

It appears that the men in Nellie’s life did all they could to prevent Nellie Ohr from being outed for being involved in the dossier because she also has links to the CIA and therefore to John Brennan.

Now this…

 

New evidence suggests Nellie Ohr was working for the CIA and Fusion GPS when she passed on the junk Trump-Russia dossier and information on the Trump Children to the DOJ-FBI.

35 Key People Involved In The Russia Hoax Who Need To Be Investigated

As their desperate search for collusion continues, Democrats want to interview 81 people. Try this list instead.

Funny how things change. The Washington Post couldn’t say a nice thing about congressional Republican efforts to investigate the Obama administration and FBI shenanigans that occurred before and after the 2016 election. That’s if they even covered these efforts at all.

 

But with Democrats controlling the House, and that legislative body’s subpoena power, the establishment media’s line has changed. Democrats on the House Judiciary Committee have just sent letters to 81 people, all associated with President Trump or the Russia probe, demanding answers on Russian election interference.

 

This is part of Democrats’ effort to continue their hunt for proof of Russia collusion—although they are already sure that Trump is guilty—as Special Counsel Robert Mueller’s investigation appears to be winding down. To cover these events, the Post’s Philip Bump wrote an article titled: “The 81 people and organizations just looped into the Trump probe—and why they were included.” Of course, the article is totally unquestioning of the House Democrats’ desired narrative and motivations.

 

Investigated, But Not for the Reasons Dems Give

 

It isn’t worth it to go through Bump’s whole article, but even the commentary about the first name on the list—Rinat Akhmetshin—omits glaring and important facts. Bump says Akhmetshin “joined his colleague Natalia Veselnitskaya, a lawyer linked to the Kremlin, at the June 9, 2016, meeting in Trump Tower predicated on providing information that would undermine Hillary Clinton’s campaign.” But, Bump says, “the focus of the meeting instead reportedly focused on the Magnitsky Act—a law that resulted in sanctions on numerous prominent Russians.”

 

Bump somehow forgets to tell us that Fusion GPS, the opposition research firm hired by Hillary Clinton to create nefarious ties between Trump and Russia, was working with Akhmetshin and Veselnitskaya to lobby for the Russian government. Fusion GPS even provided the documents that were handed out at that Trump Tower meeting. Fusion GPS head Glenn Simpson also met with the Russians both before and after that Trump Tower meeting. Yet Simpson isn’t on the Democrats’ list.

 

So there’s a few people on the Democrats’ list who should be investigated, but not for the reasons Democrats say. Some should also be charged with crimes.

 

The following all played a part in the stunning and successful effort by Hillary Clinton’s campaign to infect the executive branch of the federal government with Trump-Russia conspiracy theories. Various writings—either authored by a Brit with ties to the Kremlin who was indirectly paid by Clinton’s campaign, or directly written by Hillary Clinton cronies—were funneled into the federal government through multiple avenues.

 

Partisan Democrats in the Obama administration were all too willing to believe the allegations, and use them as an excuse for bad behavior whether they believed them or not.

 

The documents have been called “dossiers,” but that really just attaches a fancy term to a Word document full of unverified mumbo jumbo that alleged Trump-Russia collusion. Those Word documents were then used to spy on the opposing political party’s presidential campaign, and to plant stories in the media right before the election insinuating that Trump had nefarious ties with Russia.

 

Here are 36 people who should be interviewed under oath, if they have not been interviewed already, some of whom should be subjected to criminal prosecution.

 

Obama and Comey’s FBI People

 

Gregory Brower was Jim Comey’s FBI congressional liaison, and left the agency in 2018. Brower was in Comey’s inner circle, and like many in Comey’s inner circle, Brower played the game of claiming things were classified when they were not, in order to label Republican investigators as leakers and hide how the FBI used the “dossiers.” Brower was called out by Sens. Chuck Grassley and Lindsey Graham for that.

 

Kevin Clinesmith, a former FBI lawyer, wrote anti-Trump texts with former top FBI officials Peter Strzok and Lisa Page. According to the Washington Times, Clinesmith “worked on the 2016 probe into Hillary Clinton’s email use [known as Mid-Year-Exam], then worked on the FBI’s original investigation into the Trump campaign [known as Crossfire Hurricane] and, eventually, with the special counsel’s investigation into Mr. Trump’s presidential campaign.”

 

But Clinesmith, like Strzok, was let go from Mueller’s investigative team once his anti-Trump texts were uncovered by the FBI inspector general (IG), who is tasked with uncovering wrongdoing at the FBI. “Viva le resistance,” Clinesmith said in one text.

 

Joseph Pientka, an FBI official, was the go-between for Fusion GPS and the FBI. Pientka interviewed Department of Justice official Bruce Ohr on at least 12 occasions, who passed on the information Ohr’s wife Nellie (who worked for Fusion GPS) was receiving from Christopher Steele (who also worked for Fusion GPS), and who was using Edward Baumgartner, a British national with ties to Moscow, to compile the dossier for the Clinton campaign.

 

Steele was originally the direct FBI source, despite his ties to the Clinton campaign through Fusion GPS, but when Steele was caught leaking to the media to paint Trump as a Russian stooge just before the election, official FBI rules said that Steele’s use as an FBI source had to be discontinued. The FBI top brass worked around these rules, which are in place to prevent this very kind of abuse, by using Pientka to interview Ohr, who was getting his information from Steele.

 

Pientka also played a role in the interview of former Trump national security advisor Mike Flynn, where Pientka and Strzok interviewed Flynn, and Department of Justice (DOJ) and FBI officials (including former deputy attorney general Sally Yates) used that interview to entrap Flynn for a completely non-nefarious conversation with the Russian ambassador. The pretext for the interview was the Logan Act, a 200-year old law that has never led to a conviction and is probably unconstitutional. Plus, it is violated by every incoming administration, as they seek to begin conducting foreign policy during the transition period.

 

All Flynn did was talk to the Russian ambassador and try to get Russia to not retaliate against sanctions Obama placed on Russia right before leaving the White House, and to not allow an anti-Israel vote at the United Nations. The Obama administration was going to allow this vote in the final days of Obama’s presidency, an unprecedented move.

 

Although Flynn was never charged with violating the Logan Act, he was later charged with lying to the FBI investors sent to interview him, under the pretext of a possible Logan Act violation—even though the agents didn’t think he was lying at the time, and even though the FBI had wiretapped access to the record of Flynn’s conversation with the Russian ambassador.

 

What happened to Flynn is a disgrace, and a total perversion of our justice system. And it is just one example in the dangerous trend of the left using our justice system to take out political opponents, where Democrat politicians point out a target or a supposed crime, and the federal bureaucracy dutifully moves into action.

 

Obama’s DOJ People

 

Tashina Gauhar is a Department of Justice attorney who was deeply involved in applications to the Foreign Intelligence Surveillance (FISA) Court, which were used to spy on the Trump campaign using the dossiers. Gauhar was also one of the few people to see or be notified of the existence of missing Hillary Clinton emails found on Anthony Weiner’s computer. Weiner was being investigated for pedophilia and was married to top Clinton aide Huma Abedin.

 

Gauhar and Andrew McCabe sat on those emails, and a cursory investigation—led by anti-Trump FBI agent Strzok—was only conducted when FBI field agents in New York threatened to go public. Gauhar later played a role in recommending former attorney general Jeff Sessions’ recusal from overseeing Mueller’s probe.

 

John Carlin is the head of the Justice Department’s National Security Division, and got out of the DOJ in late 2016. He was the former chief of staff to Mueller, when Mueller led the FBI in the 2000s. Carlin was involved in the FBI’s systemic abuse of the FISA surveillance laws, which included spying on the Trump campaign.

 

This included omitting information on FBI wiretap abuse to the FISA court, and omitting information when applying to spy on Trump campaign official Carter Page to the FISA court. Carlin was also regularly briefed on and involved with the FBI’s overall investigation into the Trump campaign, called Crossfire Hurricane.

 

David Laufman is a high-level DOJ official in the national security division. Laufman worked with FBI counterintelligence guy Strzok on both the Clinton email investigation and the investigation into the Trump campaign based on the still-unproven, Clinton-paid, and Russian-sourced “dossier.”

 

Mary McCord was the acting assistant attorney general for a time, replacing Carlin as the head of the DOJ’s national security division. She left the DOJ in 2017. McCord played a role in Yates’s plan to spy on Flynn and entrap him with the Logan Act.

 

George Toscas, a senior official in the Justice Department, was in charge of the “Mid-Year-Exam” investigation into Clinton’s email abuses. Toscas had a front seat to both McCabe and Comey’s efforts to hide the fact that Clinton’s emails were found on Weiner’s computer, and former Obama attorney general Loretta Lynch’s efforts to stymie the Clinton email investigation.

 

The importance of Hillary’s emails wasn’t just her flouting security rules. Many have speculated that Hillary’s 30,000 missing emails, which were stored on her home-brew server, would have shown pay-to-play activities Clinton conducted while Obama’s secretary of state.

 

Obama’s State Department People

 

Victoria Nuland was a top Obama State Department official, and potentially Clinton’s secretary of state. Nuland had a role in pushing Fusion GPS conspiracy theories in the State Department, and in the broader Obama administration.

 

She received the Steele dossier just after it was created, via Jonathan Winer, in July 2016. That was possibly two months before the document was in the hands of the FBI, unless the FBI had it sooner than we currently know. She then ultimately gave permission for the FBI to make the contact with Steele, which was initiated by Michael J. Gaeta, an FBI agent based in Rome who became Steele’s handler.

 

Steele even came to the State Department to directly brief officials on his work, paid for by the Clinton campaign. Nuland had an awkward exchange with Sen. Richard Burr, where she claimed she “actively” avoided this Steele briefing, but also said she didn’t hear about the briefing until after it occurred.

 

Safe to say that if Nuland was tied to the Trump campaign, she would already be indicted for perjury by Mueller’s team of angry Democrats.

 

Jonathan Winer was a top Obama State Department official. Winer received documents alleging Trump-Russia collusion from notorious Clinton guy Cody Shearer, through another even more notorious Clinton guy named Sidney Blumenthal, and received the Steele dossier from Steele in summer 2016.

 

Winer shared the contents of these documents with his boss, Nuland, and prepped a summary of these docs for the State Department. He also gave the Shearer document to Steele, who then gave it to the FBI. That both Shearer and Blumenthal are known Clinton cronies and hatchet-men never seemed to be important to Winer. Winer was also a source for at least two journalists who wrote articles prior to the election based on the Steele dossier.

 

Jonathan Finer was another Obama State Department official, and the chief of staff to former secretary of state John Kerry. Finer got the so-called dossier from Winer, and gave it to John Kerry. This of course, among several other pieces of information, raises questions as to whether President Obama saw the dossiers and knew about what was being done to the Trump campaign.

 

Elizabeth Dibble was the deputy chief of mission at the U.S. embassy in London. She was reported to be one of the State Department officials who received information from Australian ambassador to the U.K. Alexander Downer, who has ties to the Clinton Foundation, about George Papadopoulos saying to Downer that Joseph Misfud—a European professor with potential ties to western intelligence agencies—told Papadopoulos that Russia had dirt on Hillary Clinton.

 

Misfud allegedly told Papadopoulos this in April 2016, and Papadopoulos allegedly told Downer what Misfud had said in early May. It is entirely possible that Papadopoulos was set up by Misfud, who has now disappeared and is hopefully just in hiding and not at the bottom of some body of water.

 

This chain of events became important when the FBI began using the Papadopoulos tip as an excuse for its “Crossfire Hurricane” investigation into the Trump campaign, in order to say why they didn’t rely on the Clinton-funded dossier.

 

But the FBI didn’t open Crossfire Hurricane until several months after the Dibble-Downer tip was received, and that tip, if it ever even occurred, didn’t go through the normal and proper chain of intelligence (others have claimed that the tip wasn’t taken seriously until the Democratic National Committee hack was made public).

 

More damning for the FBI’s Papadopoulos excuse was that they didn’t interview Papadopolous until after the 2016 election, and went after Carter Page for FISA surveillance instead. This was no damning piece of firsthand information, or emergency. It was hearsay, and what Papadopoulos said to Downer, and what Misfud said to Papadopoulos, is still disputed.

 

The reality is that the Clinton-funded dossier started the FBI’s investigation into Trump, at least the official Crossfire Hurricane investigation.

 

Finally, Thomas Williams is another State Department guy in the London embassy. Colin KahlKathleen Kavalec, and Lewis Lukens were all State Department officials who had some sort of interaction with the dossier, or Fusion GPS people.

 

People Tied to the DNC or Clinton Campaign

 

Perkins Coie, a law firm, was paid by the Clinton campaign to serve as a go-between to hide the fact that Hillary’s campaign was paying Fusion GPS to push the Trump-Russia smear.

 

Marc Elias is a lawyer at Perkins Coie, who hired Fusion GPS for the Clinton campaign.

 

Michael Sussmann is another lawyer at Perkins Coie, who received a story about a Russian bank, Alphabank, communicating with a server in Trump Tower from Fusion GPS. Sussmann went directly to the FBI with that story—to James Baker, who was general counsel of the FBI under Comey—prompting reports midway through the 2016 campaign that hinted Trump had nefarious ties with Russia.

 

Although it was widely debunked, the server angle again showed up in media stories, including in New York Times and Slate articles, right before the election in September of 2016. Hillary Clinton even tweeted that Slate article when it posted.

 

Robbie Mook was a top Hillary Clinton campaign official. As Fusion GPS was working on the dossier, Perkins Coie was getting the information from Steele and briefing Mook. It is important to note that Mook was the first Hillary official to publicly say that Russia wanted to help Trump win. Mook said this right before the Democratic National Convention.

 

This is more evidence that Clinton’s campaign is the entity that started the Russia investigation, by alleging that Trump had nefarious ties with Russia to distract from the DNC and Clinton campaign’s mistreatment of Bernie Sanders, as was revealed by the DNC email theft that was leaked by WikiLeaks right before the Democrats’ 2016 national convention.

 

Jake Sullivan is another top advisor in Clinton’s campaign, who played a role in forming the Trump-Russia collusion narrative.

 

Cody Shearer is a longtime Clinton dirty tricks guy, with a record of smearing the Clintons’ political opponents. He authored a “dossier,” largely based on Steele’s work, that was picked up by Winer at Obama’s State Department.

 

Sidney Blumenthal is an even more infamous Clinton stooge. “Sid” is so infamous that Obama told Hillary that he didn’t want Blumenthal associated with the Obama administration. Blumenthal got the Trump-Russia conspiracies written by Shearer into the Obama State Department, when only the Clinton campaign was talking about Trump-Russia collusion.

 

Fusion GPS People

 

Fusion GPS is a D.C. based opposition research and public relations firm with a history of representing less-than-savory actors, including Planned Parenthood, the Venezuelan dictatorship of Nicolas Maduro, and Vladimir Putin’s Russia. Fusion has been shown in court documents to have paid still-unknown journalists, likely for the placement of stories or to push a certain narrative.

 

Rinat Akhmetshin is the aforementioned Russian spy guy who was working with Fusion GPS when he showed up in Trump Tower. Get him under oath and ask him how much he knew about Fusion’s work for the Clinton campaign.

 

Edward Baumgartner is the British national, fluent in Russian and with ties to the Kremlin, who actually worked on most of Steele’s dossier. To compile the dossier, Baumgartner used unknown Russian sources that were paid and totally unverified, possibly tied to the Kremlin.

 

Peter Fritsch is a partner at Fusion GPS.

 

Mary Jacoby is the wife of Fusion GPS head Simpson, and has bragged publicly that her husband started the Russia investigation.

 

Shailagh Murray was a senior advisor to the Obama administration. Her husband is Neil King Jr., who works at Fusion GPS.

 

Neil King Jr., a Fusion GPS guy married to Murray, was also Obama’s top communications advisor. On a related story, Politico quoted King without mentioning he worked for Fusion GPS. This is just one of many examples of the endless ties between reporters and Fusion GPS, and between so-called journalists and prominent Democrats.

 

Thomas Catan is a Fusion GPS executive. He pled the Fifth in front of Congress when asked questions about the role of the dossier for the Hillary campaign.

 

Daniel Jones, a former staffer to Sen. Dianne Feinstein, heads the Penn Quarter Group, a D.C. “consulting firm.” He also heads a “nonprofit” called the “Democracy Integrity Project.” Jones’ groups have received millions from the likes of George Soros and Tom Steyer, two leftwing billionaires, to continue investigations into Trump via Fusion GPS. It appears as if Jones began picking up the tab for Fusion to continue its work as soon as the Clinton campaign and the DNC stopped paying Fusion after the election.

 

Glenn Simpson is the head of Fusion GPS. There are lots of indications that he lied to Congress during his testimony about Nellie Ohr, the wife of DOJ official Bruce Ohr, before it was publicly known that Nellie worked for Fusion GPS. Specifically, Simpson told Congress that only Baumgartner spoke Russian at Fusion. But Nellie spoke Russian, and she was largely hired because she was a Russia expert (and because her husband worked at DOJ).

 

Simpson also lied about the timing of his contacts with Bruce Ohr. Again, if he were associated with Trump, he would have been indicted by Mueller already.

 

The Big Fish

 

Of course, there’s also former director of national intelligence Jim ClapperComey and Andrew McCabe at FBI, and former CIA director John Brennan.

 

Comey and McCabe are leakers, and should be prosecuted as such. Brennan is a particular bad actor, and did much to spread the dossiers around the federal government and our intelligence community. It is also thought that Brennan pushed the FBI to investigate Trump, or at least increase the intensity of its spying on Trump’s campaign.

 

Will any of these guys ever be prosecuted? Better said, does new Attorney General Bill Barr care about the rule of law or not?

 

So Many Questions Yet to Be Answered

 

Was the Kremlin behind this whole thing, in order to sow distrust in the American political process? If so, that would make far too many Democrats their “useful idiots.” Why isn’t there more uproar about the fact that Fusion GPS was working for Russia while it was working for the Clinton campaign?

 

The other gnawing problem is the timeline to all of this. In early June 2016, the DNC publicly said that it had been hacked, two days after WikiLeaks announced that it had information that showed Clinton and the DNC were mistreating Sanders. Right away, Steele began his work for Fusion GPS in June.

 

The DNC says it first noticed that it was hacked on April 28, 2016. But DNC staffers weren’t forced to turn over their presumably infected equipment until June 10, 2016. And numerous set-up attempts of Trump campaign people occurred during 2016, possibly as early as April 2016.

 

You don’t have to think that the Clintons killed Seth Rich to think something stinks to high heaven here. Justice has been grossly miscarried, on a high and far-reaching level. If this is what America is to be like going forward, it will be only a shell of what it once was in the past. The only hope is for Barr’s DOJ to swing into action.

I wish I count ML McCarren as a friend. But the truth is I’ve never met him or even know what he looks like. I gotta tell ya though, this guy finds some very informative stuff that I dare say the Mainstream Media will not share.

1️⃣. CIA Director John Brennan, with some assistance from Director of National Intelligence James Clapper, gathered foreign intelligence and fed it throughout our domestic Intelligence Community.

2️⃣. The FBI became the handler of Brennan’s intelligence and engaged in the more practical elements of surveillance.

3️⃣. The Department of Justice facilitated investigations by the FBI and legal maneuverings, while providing a crucial shield of nondisclosure.

4️⃣. The Department of State became a mechanism of information dissemination and leaks.

5️⃣. Hillary Clinton’s presidential campaign and the Democratic National Committee provided funding, support, and media collusion.

6️⃣. Obama administration officials were complicit, and engaged in unmasking and intelligence gathering and dissemination.

7️⃣. The media was the most corrosive element in many respects. None of these events could have transpired without their willing participation.

✔️Stories were pushed, ✔️facts were ignored, and ✔️narratives were promoted.

Let’s start with a simple premise: The candidacy of Trump presented both an opportunity and a threat.

Initially not viewed with any real seriousness, Trump’s campaign was seen as an opportunistic wedge in the election process. 💡At the same time, and particularly as the viability of his candidacy increased, Trump was seen as an existential threat to the established political system.

👉The sudden legitimacy of Trump’s candidacy was not welcomed by the U.S. political establishment. Here was a ✔️true political outsider who ✔️held no traditional allegiances. He was ✔️brash and boastful, he ✔️ignored political correctness, he ✔️couldn’t be bought, and he ✔️didn’t care what others thought of him—he trusted himself.

👉Governing bodies in Britain and the European Union were also worried. Candidate Trump was ✔️openly challenging monetary policy, ✔️regulations, and ✔️the power of special interests. He ✔️challenged Congress. He ✔️challenged the ✔️United Nations and the European Union. ➡️He questioned everything.

💡Clinton Campaign and the DNC

The Clinton campaign and the Democratic National Committee both occupied a unique position. They had the most to gain but they also had the most to lose. 👉And they stood willing and ready to do whatever was necessary to win. Hillary Clinton’s campaign manager, Robby Mook, is credited with being the first to raise the specter of candidate Donald Trump’s alleged collusion with Russia.

💥The entire Clinton campaign willfully promoted the narrative of Russia–Trump collusion despite the uncomfortable fact that they were the ones who had engaged the services of Fusion GPS and Christopher Steele through their law firm Perkins Coie. Information flowed from the campaign—sometimes through Perkins Coie, other times through affiliates—ultimately making its way into the media and sometimes to the FBI. Information from the Clinton campaign may also have ended up in the Steele dossier.

👉(The) statements, which were later proven to be incorrect, are all the more disturbing with the hindsight knowledge that it was a senior Clinton/DNC lawyer who helped plant the story. And given the prepared statement by Sullivan, the Clinton campaign knew this.

As the details behind the Spygate scandal are uncovered, the connections to former President Obama are unearthed.

 

According to Zero Hedge, the head of opposition research firm Fusion GPS admitted in December 2017 in a court filing that his firm paid the wife of a senior Justice Department official to help dig up damaging information on then-candidate Donald Trump.

 

Glenn Simpson, co-founder of Fusion GPS, filed the signed declaration in a D.C. court this week affirming that Nellie Ohr, wife of demoted DOJ official Bruce Ohr, was contracted by Fusion through the summer and fall of 2016 “to help our company with its research and analysis of Mr. Trump,” according to the filing. The House Intelligence Committee determined that in November 2016, Simpson met with Bruce Ohr shortly after the election to discuss their findings regarding Russia and Trump. Bruce Ohr lost his senior-level position at the DOJ as associate deputy attorney general after his meetings with Simpson and British spy Christopher Steele, who assembled the Trump-Russia dossier, were discovered.

 

And why would Fusion GPS hire Nellie Ohr? Aside from the obvious connection to her DOJ husband who was in a position to provide Fusion GPS with information on Trump gathered by US intelligence agencies, Nellie Ohr also represented the CIA’s “Open Source Works” group in a 2010 “expert working group report on international organized crime” along with Bruce Ohr and Glenn Simpson.

 

The connections between Nellie Ohr and the ‘Spygate’ scandal were hidden at a distance for months.

 

As noted last week at TGP, Nellie Ohr is a Communist sympathizer connected to Russia as well as a corrupt Never-Trumper.

 

American Spectator recently posted an article on Nellie Ohr, who they call “the “dossier” spying scandal’s woman in the middle.”

 

To one side of Ohr, there is the Fusion GPS team, including fellow contractor Christopher Steele. To the other, there is husband Bruce Ohr, who, until his “dossier”-related demotion, was No. 4 man at the Department of Justice, and a key contact there for Steele.

 

As central as Nellie Ohr’s placement is, her role in the creation of the “dossier” remains undefined. For example, the House Intelligence Committee memo on related matters vaguely tells us that Nellie Ohr was “employed by Fusion GPS to assist in the cultivation of opposition research on Trump”; the memo adds that Bruce Ohr “later provided the FBI with all of his wife’s opposition research.” Senator Lindsey Graham more sensationally told Fox News that Nellie Ohr “did the research for Mr. Steele,” but details remain scarce.

 

What’s more revealing about Nellie Ohr is the men in her life are protecting her involvement in the Russia scandal:

 

Notably, the “dossier” men in her life have tried to shield Ohr from public scrutiny, even at professional risk. Her husband, as the Daily Caller News Foundation reports, failed to disclose his wife’s employment with Fusion GPS and seek the appropriate conflict-of-interest waiver, which may have been an important factor in his demotion from associate deputy attorney general late last year.

 

Under Senate and House questioning, Fusion GPS co-founder Glenn Simpson consistently failed to disclose Nellie Ohr’s existence as one of his firm’s paid Russian experts, let alone that he hired her for the red-hot DNC/Clinton campaign Trump-Russia project.

 

Even Christopher Steele may have tried to keep Nellie Ohr “under cover.” Steele, put forth as the “dossier” author ever since its January 2017 publication in BuzzFeed, does not appear to have let on to his many media and political contacts that he had “dossier”-assistance from at least two fellow Fusion GPS Russian experts, Nellie Ohr and Edward Baumgartner. Baumgartner, interestingly, was a Russian history major at Vassar in the 1990s when Nellie Ohr taught Russian history there.

 

Yesterday, President Trump’s attorney, former New York City Mayor, Rudy Giuliani outed former Obama CIA Director John Brennan as the man in charge of ‘Spygate’.  Rudy claims Brennan orchestrated the ‘Spygate’ scandal and was the quarterback:

Strzok is a bit of a puppet. Then there’s Mueller, he’s a puppet. The people working for him, some of them are,” he continued.

 

Hannity cut of Giuliani saying, “I have a funny feeling you are about to drop a bomb on me.”

 

Giuliani and Hannity were discussing the firing of disgraced FBI agent Peter Strzok, which happened earlier on Monday.

 

“Well the guy running it is (John) Brennan and he should be in front of a grand jury. Brennan took an affidavit – a dossier, unless he’s the biggest idiot intelligence agent that ever existed, although he never did much intelligence work, it’s false. You could look at it and laugh,” Giuliani stated.

It appears that the men in Nellie’s life did all they could to prevent Nellie Ohr from being outed for being involved in the dossier because she also has links to the CIA and therefore to Brennan.

 

If Brennan is outed as the quarterback of the dossier scandal, then by association, so is his boss, former President Obama.

 

Now we know that communist sympathizer Nellie Ohr, and the men who surrounded her, her husband, business partners, John Brennan, and by association President Obama, were all connected.  Together they attempted to prevent Candidate Trump from being elected and later to remove duly elected President Trump from office.

Mark Levin is on a tear and it is a wonder to behold. I just watched him provide solid proof on Fox News on how all these police tactics against President Trump did indeed occur. The media provided most of the proof themselves that the two FISA requests were sought by Obama… the first one in June of last year, which mentioned Trump directly and was denied, and a second that occurred in October last year and was narrowed in scope, then was approved. It looks like it may have been targeting a server in the White House that was emailing Russian banks supposedly. No wrongdoing was found, unless of course you count what Obama did.

 

Levin has laid out exactly how this should be investigated and he has the full attention of the White House. His findings and recommendations have been circulated to several White House staffers, according to Washington Post reporter Robert Costa. The FISA orders and transcripts should now be made public and hearings should begin over all this. The media is still insisting there is no proof, when they provided said proof. This is insane.

Mark Levin, Conservative Review’s editor-in-chief, recommends the Trump administration open an investigation into Barack Obama. Levin states the former president’s team used police-state tactics against then-candidate Trump during the 2016 election.

 

“The gravity of this is unparalleled. It appears that during the course of a presidential election, the Obama administration used both intelligence and law enforcement agencies to investigate the Republican nominee’s campaign and certain surrogates,” Levin tells Conservative Review.

 

Levin – who served as chief of staff for President Reagan’s Attorney General Ed Meese – explained the potential scandal on his Thursday evening radio show:

 

“We have a prior administration – Barack Obama and his surrogates – who are supporting Hillary Clinton and her party, the Democratic Party. Who were using the … intelligence activities to surveil members of the Trump campaign, and to put that information out in the public.

 

“The question is: Was Obama surveilling top Trump campaign officials during the election?” Levin asked on “The Mark Levin Show.”

 

Mark Levin is calling this a silent coup. And he is correct. I’ve looked right at this evidence for months and I never connected the dots. I’m so glad Levin did. It is obvious to me that Barack Obama did know about all this and had Lynch at the DOJ once again do his dirty work. There was and is an orchestrated plan to sabotage the Trump presidency and not only stop him from getting his appointees approved, but stop him from accomplishing anything of merit or that would hurt the Obama legacy.

 

A myriad of things now look very connected. The protests and riots, Valerie Jarrett moving into Obama’s mansion, Jarrett’s daughter being hired by CNN to cover the DOJ and Jeff Sessions when she’s not even a journalist, the attack on Jeff Sessions himself, and on and on and on. When do we wake up and realize we are at war within? And that Obama and his activists must be stopped and held accountable. You’ve got Loretta Lynch literally calling for blood and death in our streets: …They’ve marched, they’ve bled and yes, some of them died. This is hard. Every good thing is. We have done this before. Exclusive: Joseph Farah reveals why scandal is ‘bigger and worse than Watergate’

After Donald Trump blew the whistle on the eavesdropping of his 2016 campaign headquarters by Barack Obama’s administration, few in the media or elsewhere seem to be asking the obvious questions:

Was it legal?

 

Was it ethical – in the American way?

 

One thing is for certain: If the roles were reversed and the Trump administration bugged Democrats, you can imagine the media would take a much different view.

 

Let’s first take a look at how the media reported this travesty of justice, political decorum, the Constitution and American legal tradition:

 

  • Washington Post: President Trump on Saturday angrily accused former President Barack Obama of orchestrating a “Nixon/Watergate” plot to tap the phones at his Trump Tower headquarters in the run-up to last fall’s election, providing no evidence to support his explosive claim and drawing a flat denial from Obama’s office.

 

  • CNN: Trump’s baseless wiretap claim

 

  • Atlantic: Trump’s Unfounded Claims of a “Nixon/Watergate” Wiretapping Scheme

 

  • Huffington Post: Obama Refutes Allegation that He Wiretapped Trump Tower During Campaign

 

  • New York Daily News: Trump’s poor understanding of national security investigations may prove dangerous

 

  • New York Times: President Trump on Saturday accused former President Barack Obama of tapping his phones at Trump Tower the month before the election, leveling the explosive allegation without offering any evidence.

 

The emphasis of all of these “fake news” reports is disingenuous to say the least. Obama didn’t deny his administration wiretapped Trump. He said no one at the White House did. That is a virtual admission that his administration did, probably Justice Department, meaning the “apolitical Loretta Lynch” who just called for “blood and death” in the streets to stop Trump, much to the approval of Senate Democrats. It’s an obvious parsing of words by the slick Obama.

 

The accusation is indeed bigger than Watergate, which began with an attempt not to eavesdrop directly on Richard Nixon’s opponent in the 1972 presidential election, but on Larry O’Brian, the head of the DNC, whose offices were in the Watergate Hotel. He was the Debbie Wasserman-Schultz of his day, but she and Hillary Clinton campaign Chairman John Podesta didn’t bother securing their email communications, and you could read them all on WikiLeaks.

 

And that brings us to the excuse for Trump’s campaign being undoubtedly bugged – the elusive evidence for Russian hacking and interference in the 2016 U.S. election.

 

If you doubt there is no evidence, just carefully read every New York Times story on the fake scandal. Way down near the bottom of every story, the paper that has trumpeted this story the most admits there’s no evidence.

 

So, here’s the way this thing obviously went down.

 

Obama’s team first tried to get a broad FISA warrant to investigate the Russian fantasy. The judge turned it down.

 

It tried again with a narrower FISA warrant request. The judge turned it down.

 

Then it tried a third time, and the judge approved it in October. Coincidentally, that is the exact time Trump says the wiretapping began.

 

Not one of these big news organizations will tell you that.

 

It’s the attorney general who would request such wiretap authorizations for heavy-duty, politically charged requests such as this – not that any have ever been requested or authorized in the history of the republic.

 

Do news organizations really want to be covering up stuff like this? Don’t they understand the same tactics can be used against them? Obama, or (wink-wink) Lynch, just set the precedent.

 

Nixon never did anything remotely like this – and he was forced from office as a result. Obama or Lynch could well be prosecuted by the Trump administration. And one or both probably should be.

 

Misuse of FISA statutes is a clear violation of the law.

 

FISA can only be used for “foreign intelligence information” as the basis for surveillance to protect the U.S. against a “grave” or “hostile” attack, war-like sabotage or international terror.

 

Does anyone suggest such a thing with regard to Russian hacks?

 

That’s what makes this scandal, pardon the expression, “bigger than Watergate.”

 

Out of more than 35,000 FISA court requests, only 12 have ever been rejected. But two out of three requested by the Obama administration to investigate the Russia deal were. What does that tell you?

 

It tells me this was a political fishing expedition to build a case against Trump if or when he beat Hillary.

 

Since the election, the hysteria over Russia’s role in the election has only increased exponentially.

 

And that’s why:

 

1. I believe Trump.

2. I don’t believe Obama.

3. I don’t believe the “fake news cartel,” which is all in for finding the elusive Trump-Russia link.

 

What we’ve got here at first glance is a prima facie case for “bigger and worse than Watergate.”

 

But the Washington Post and New York Times have already signaled they won’t be investigating. They are already publishing front-page editorials that stake out a rather shrill “see-no-evil, hear-no-evil, speak-no-evil” approach.

 

Was it legal? No.

 

Was it ethical in the American political tradition? No.

 

Is it one of the most dangerous developments in American political history? Yes.

The Obama Camp’s Disingenuous Denials on FISA Surveillance of Trump

President Trump’s early Saturday morning tweeting has exploded to the forefront an uncovered scandal I’ve been talking about since early January (including in this weekend’s column): The fact that the Obama Justice Department and the FBI investigated associates of Donald Trump, and likely Trump himself, in the heat of the presidential campaign.

 

To summarize, reporting indicates that, prior to June 2016, the Obama Justice Department and FBI considered a criminal investigation of Trump associates, and perhaps Trump himself, based on concerns about connections to Russian financial institutions. Preliminary poking around indicated that there was nothing criminal involved. Rather than shut the case down, though, the Obama Justice Department converted it into a national-security investigation under the Foreign Intelligence Surveillance Act (FISA). FISA allows the government, if it gets court permission, to conduct electronic surveillance (which could include wiretapping, monitoring of e-mail, and the like) against those it alleges are “agents of a foreign power.”
FISA applications and the evidence garnered from them are classified – i.e., we would not know about any of this unless someone had leaked classified information to the media, a felony. In June, the Obama Justice Department submitted an application that apparently “named” Trump in addition to some of his associates.

 

As I have stressed, it is unclear whether “named” in this context indicates that Trump himself was cited as a person the Justice Department was alleging was a Russian agent whom it wanted to surveil. It could instead mean that Trump’s name was merely mentioned in an application that sought to conduct surveillance on other alleged Russian agents. President Trump’s tweets on Saturday claimed that “President Obama . . . tapp[ed] my phones[,]” which makes it more likely that Trump was targeted for surveillance, rather than merely mentioned in the application.

 

In any event, the FISA court reportedly turned down the Obama Justice Department’s request, which is notable: The FISA court is notoriously solicitous of government requests to conduct national-security surveillance (although, as I’ve noted over the years, the claim by many that it is a rubber-stamp is overblown).

 

Not taking no for an answer, the Obama Justice Department evidently returned to the FISA court in October 2016, the critical final weeks of the presidential campaign. This time, the Justice Department submitted a narrowly tailored application that did not mention Trump. The court apparently granted it, authorizing surveillance of some Trump associates.

 

It is unknown whether that surveillance is still underway, but the New York Times has identified – again, based on illegal leaks of classified information – at least three of its targets: Paul Manafort (the former Trump campaign chairman who was ousted in August), and two others whose connection to the Trump campaign was loose at best, Manafort’s former political-consulting business partner Roger Stone, and investor Carter Page.

 

The Times report (from mid-January) includes a lot of heavy breathing about potential ties between the Trump campaign and Russia; but it ultimately concedes that the government’s FISA investigation may have nothing to do with Trump, the campaign, or alleged Russian efforts to interfere in the U.S. election by hacking e-mail accounts. Trump’s tweets on Saturday prompted some interesting “denials” from the Obama camp. These can be summarized in the statement put out by Obama spokesman Kevin Lewis:

 

A cardinal rule of the Obama Administration was that no White House official ever interfered with any independent investigation led by the Department of Justice. As part of that practice, neither President Obama nor any White House official ever ordered surveillance on any U.S. citizen. Any suggestion otherwise is simply false.

 

This seems disingenuous on several levels. First, as Obama officials well know, under the FISA process, it is technically the FISA court that “orders” surveillance. And by statute, it is the Justice Department, not the White House, that represents the government in proceedings before the FISA court. So, the issue is not whether Obama or some member of his White House staff “ordered” surveillance of Trump and his associates.

 

The issues are (a) whether the Obama Justice Department sought such surveillance authorization from the FISA court, and (b) whether, if the Justice Department did that, the White House was aware of or complicit in the decision to do so. Personally, given the explosive and controversial nature of the surveillance request we are talking about – an application to wiretap the presidential candidate of the opposition party, and some of his associates, during the heat of the presidential campaign, based on the allegation that the candidate and his associates were acting as Russian agents – it seems to me that there is less than zero chance that could have happened without consultation between the Justice Department and the White House. Second, the business about never ordering surveillance against American citizens is nonsense. Obama had American citizens killed in drone operations. Obviously, that was not done in the U.S. or through the FISA process; it was done overseas, under the president’s commander-in-chief and statutory authority during wartime.

 

But the notion that Obama would never have an American subject to surveillance is absurd. Third, that brings us to a related point: FISA national-security investigations are not like criminal investigations. They are more like covert intelligence operations – which presidents personally sign off on. [Blog Editor’s bold text]

 

The intention is not to build a criminal case; it is to gather information about what foreign powers are up, particularly on U.S. soil. One of the points in FISA proceedings’ being classified is that they remain secret – the idea is not to prejudice an American citizen with publication of the fact that he has been subjected to surveillance even though he is not alleged to have engaged in criminal wrongdoing. Consequently, there is nothing wrong, in principle, with a president’s ordering national-security surveillance of a potential foreign agent who may be helping a foreign power threaten American security and interests.

 

That is one of the president’s main jobs – there would be something wrong if a president, who truly believed the nation was threatened by a foreign power, failed to take action. Prior to FISA’s enactment in 1978, courts had no formal role in the surveillance of foreign agents for national-security purposes – it was a unilateral executive-branch function. Beginning with the Carter administration during FISA’s enactment, it has been the position of presidential administrations of both parties that, despite the enactment of the FISA process, the president maintains inherent authority under Article II of the Constitution to order surveillance even in the absence of court authorization. Of course, doing so is controversial, as President Bush learned after he directed the NSA to conduct warrantless wiretapping of suspected terrorists following the 9/11 attacks. Nevertheless, we should not allow the statements of Obama spokesmen to confuse us here. The Justice Department and FBI have two missions: (a) criminal law-enforcement and (b) national security. It would be scandalous (though probably not constitutional unconstitutional) for a president to interfere in the law-enforcement mission by ordering the Justice Department to prosecute someone outside its normal procedures.

 

But it would not be inappropriate  e–ven though civil libertarians would raise holy hell — for the president to direct warrantless surveillance against a target, even an American citizen, if the president truly believed that target was functioning as an agent of a foreign power threatening U.S. interests. To be clear, there does not seem to be any evidence, at least that I know of, to suggest that any surveillance or requests to conduct surveillance against then-candidate Donald Trump was done outside the FISA process.

 

Nevertheless, whether done inside or outside the FISA process, it would be a scandal of Watergate dimension if a presidential administration sought to conduct, or did conduct, national-security surveillance against the presidential candidate of the opposition party. Unless there was some powerful evidence that the candidate was actually acting as an agent of a foreign power, such activity would amount to a pretextual use of national-security power for political purposes. That is the kind of abuse that led to Richard Nixon’s resignation in lieu of impeachment. [Blog Editor’s bold text]

 

Moreover, it cannot be glossed over that, at the very time it appears the Obama Justice Department was seeking to surveil Trump and/or his associates on the pretext that they were Russian agents, the Obama Justice Department was also actively undermining and ultimately closing without charges the criminal investigation of Hillary Clinton despite significant evidence of felony misconduct that threatened national security.
